The Bernard Law Firm
Business & Civil Litigation

Ohio Business Litigation and Contract Litigation Lawyer

I represent and litigate for individuals, small businesses and large companies. I am known for my aggressive and proactive style as well as my knowledge, experience and training in litigation. I have represented individuals and businesses in a wide array of disputes. I believe that, in most instances, a lawsuit should be commenced only after the parties have attempted to resolve their differences among themselves. A negotiated settlement is usually superior to a resolution imposed upon the parties by a judge or jury. However, a negotiated settlement is not always possible. Call a vigorous and experienced Cleveland litigation attorney. Contact me at The Bernard Law Firm today to discuss your legal needs.

Business Litigation

At my law firm, I assist individuals and companies involved in business and commercial litigation. Together we assess the options and make decisions consistent with the organization’s goals. My business clients represent a broad range of industries, from health care providers and consumer products to financial services and automobile manufacturers and dealers. As a business litigation lawyer, I aggressively pursue and defend their interests in matters related to:

  • Breach of contract
  • Breach of fiduciary duty, agency or good faith
  • Breach of loan commitment
  • Breach of trust and customers' deposits
  • Class actions
  • Collections
  • Contract violations
  • Construction liens
  • Equitable set-off and estoppel
  • Lender liability after loan default
  • Negligent misrepresentation and bank reference letters
  • Security interests
  • Fraud and false advertising
  • Equal Credit Opportunity Act (ECOA)
  • Truth in lending law
  • Shareholder matters
  • Commercial leases
  • Business insurance
  • Warranty claims
  • Mismanagement of assets

Consumer Protection Litigation

I pursue and defend a full range of consumer complaints against banks, real estate brokers, motor vehicle dealers and other businesses. In addition, consumer protection laws include warranty claims, fair debt collection, credit discrimination, automobile fraud, unfair and deceptive acts and practices, fair credit reporting, lemon laws and truth in lending laws. I have represented consumers in a wide variety of consumer protection actions against companies, banks, insurance companies and automobile manufacturers and dealers.

Personal Injury and Wrongful Death

I represent plaintiffs in all types of personal injury and wrongful death litigation, including automobile, truck and train accidents; products liability; nursing home abuse and neglect; slip, trip and fall injuries; sports injuries. I have recovered hundreds of thousands of dollars representing numerous injured clients and tried matters involving personal injury and wrongful death. For example, I obtained a verdict in a federal court trial on behalf of a victim’s estate in a wrongful death action and have litigated claims involving serious injuries, including brain trauma, closed head injuries, loss of eyesight, collapsed lung and broken bones.
